SECURITY DEPOSIT — CREDIT CARD PROCESSING FEE DISCLOSURE (Colorado – C.R.S. § 5-2-212)
As permitted under Colorado law (C.R.S. § 5-2-212), the following disclosure applies if Tenant elects to pay the security deposit required under this Lease using a credit card. This Section applies only to payment of the security deposit and does not apply to rent or any other charges due under this Lease.
1. Credit Card Processing Surcharge.
If Tenant elects to pay the security deposit by credit card, a credit card processing surcharge (the “Surcharge”) will be added to the amount charged to Tenant’s card. The Surcharge is intended to offset the merchant discount fee and processing costs charged to Landlord (or its third-party payment processor) by the applicable card network and issuing bank in connection with the transaction.
2. Amount of the Surcharge.
The amount of the Surcharge is not a fixed dollar amount and may vary on a per-transaction basis. The Surcharge depends on factors outside Landlord’s control, including the type of credit card used (e.g., standard, rewards, corporate, or international), the card network (Visa, Mastercard, American Express, Discover, or other), the issuing bank, and the rates set by Landlord’s third-party payment processor at the time the security deposit is paid. Surcharges typically range from approximately 3% to 7% of the security deposit amount, but may be higher depending on the specific card used and the processor’s then-current rates. The exact Surcharge applicable to the transaction will be disclosed to Tenant at the point of payment, before the transaction is finalized.
3. No-Cost Payment Alternatives.
Tenant is not required to pay the security deposit by credit card. Landlord accepts the following alternative methods of payment for the security deposit, none of which incur a credit card processing Surcharge: ACH/electronic bank transfer (eCheck), personal check, cashier’s check, and money order [Landlord to confirm or modify accepted methods].
4. Voluntary Election; Right to Cancel.
Use of a credit card to pay the security deposit is voluntary. If, after the Surcharge is disclosed at the point of payment, Tenant does not wish to pay the Surcharge, Tenant may cancel the credit card transaction and submit the security deposit using one of the no-cost alternative methods described above.
5. Non-Refundable.
Once a credit card transaction for the security deposit has been completed, the Surcharge has been incurred by Landlord’s payment processor and is non-refundable, except as required by applicable law or as otherwise provided by the payment processor. The Surcharge is separate from, and does not become part of, the security deposit held by Landlord under the Lease and applicable Colorado law.
